1. Right of aliyah
Every Jew has the right to come to Israel as an oleh, an immigrant under this Law.
2. Oleh visa
Amendment: 5714.
(a) Aliyah shall be by an oleh visa.
(b) An oleh visa shall be granted to every Jew who expresses a wish to settle in Israel, unless the Minister of Interior is satisfied that the applicant:
(1) engages in activity directed against the Jewish people; or
(2) is likely to endanger public health or state security; or
(3) has a criminal record likely to endanger public welfare.
3. Oleh certificate
(a) A Jew who arrives in Israel and subsequently expresses a wish to settle there may receive an oleh certificate while in Israel.
(b) The restrictions in section 2(b) also apply to an oleh certificate. A person shall not, however, be considered a danger to public health because of an illness contracted after arriving in Israel.
4. Residents and children
Every Jew who made aliyah before this Law took effect, and every Jew born in the country before or after it took effect, shall be treated as having made aliyah under this Law.
4A. Rights of family members
Amendment: 5730.
(a) The rights of a Jew under this Law, the rights of an oleh under the Citizenship Law, 5712-1952, and the rights of an oleh under any other enactment also extend to a Jew's child and grandchild, a Jew's spouse, and the spouse of a Jew's child or grandchild, except a person who was Jewish and voluntarily changed religion.
(b) It is immaterial whether the Jew through whom a right is claimed under subsection (a) is alive or has made aliyah.
(c) The restrictions and conditions applying to a Jew or oleh under this Law, regulations made under it, or the enactments referred to in subsection (a), also apply to a person claiming a right under subsection (a).
4B. Definition
Amendment: 5730.
For this Law, a Jew is a person born to a Jewish mother or who has converted to Judaism and is not a member of another religion.
5. Implementation and regulations
Amendments: 5714, 5730.
The Minister of Interior is responsible for implementing this Law and may make regulations concerning its implementation and the granting of oleh visas and certificates to minors under 18. Regulations concerning sections 4A and 4B require approval by the Knesset Constitution, Law and Justice Committee.
